Terms & Conditions

By purchasing the Apex Agency Partnership (“Partnership”), you (“Client”) agree to the following Terms & Conditions with Apex Agency Ltd (“we”, “us”, “our”). Please read carefully before completing your purchase.
1. Scope of Services
Your Partnership includes:
- Apex Coaching App – Unlimited client capacity. Fully customisable workouts, nutrition plans, resources, and video content.
- GoHighLevel CRM Build & Ongoing Maintenance – Installed from our Apex snapshot, including sales pipeline, automation workflows, booking integration, and ongoing optimisation.
- VIP Skool Community Access – 24/7 access to our training library covering marketing, sales, fulfilment, and product growth.
- Weekly Group Coaching Calls – Three live sessions per week on marketing, sales, fulfilment/product.
- Private Strategy Calls – Two 1:1 calls with your assigned Client Success Manager.
- Unlimited Direct Access to Your Client Success Manager – Via email and/or chat for the duration of your subscription.
We may make non-material updates to the Services at any time to improve functionality or delivery.
2. Payment Terms
- The Partnership is billed at the rate agreed on your sales call and confirmed on the payment page.
- Payment is taken immediately upon completion of checkout.
- Subscriptions renew automatically on the billing schedule selected (monthly or annually) unless cancelled in accordance with Section 4.
3. Delivery of Services
- Apex Coaching App access is granted immediately upon payment.
- VIP Skool Community access is granted within 24 hours of payment.
- CRM Build will begin once you complete onboarding and provide all requested information.
- Group & 1:1 Calls will be scheduled after onboarding.
- Delivery is considered complete once your account credentials for any part of the Partnership are provided, regardless of whether you log in or actively use them.
4. Cancellations & Refunds
- All sales are final. Due to the digital nature of the Services and immediate access to proprietary content and systems, no refunds will be issued once payment has been processed.
- No pro-rata refunds are provided for partial billing periods.
5. Client Responsibilities
You agree to:
- Provide accurate and complete information during onboarding.
- Respond promptly to requests for information to avoid delays.
- Keep your login credentials secure and not share them with third parties.
- Use the Services only for lawful purposes and in accordance with these Terms.
6. Dispute Resolution & Chargebacks
- You agree to contact us first at admin@apexagency.uk to attempt to resolve any issue before initiating a chargeback or dispute.
- Initiating a chargeback without first attempting resolution is considered a breach of this agreement.
- If a chargeback is initiated, we will provide the payment processor with:
- Proof of your acceptance of these Terms (including timestamp and IP address from checkout).
- Proof of service delivery (login/access logs, onboarding confirmation, call attendance records).
- Copies of communication showing the agreed deliverables and your acknowledgement of them.
- You acknowledge that purchase disputes must be handled through our internal resolution process before involving any bank or payment provider.
7. Limitation of Liability
We are not liable for any indirect, incidental, or consequential damages arising from your use (or inability to use) the Services. Your success depends on your own implementation and actions. No specific results are guaranteed.
8. Governing Law
These Terms are governed by the laws of Dubai. Any disputes will be subject to the exclusive jurisdiction of the courts of United Arab Emirates.
9. Acknowledgement
By completing your purchase, you confirm that you:
- Have read and understood these Terms & Conditions.
- Understand the deliverables in Section 1.
- Accept that all sales are final once payment is processed.
- Agree that delivery is considered complete once access credentials have been issued.
10. Minimum Term Commitment
- The Apex Agency Partnership is a 12-month minimum commitment from the date of your initial payment.
- You agree to pay for all 12 months in full, regardless of your level of participation or results achieved.
- Early termination is not permitted except where agreed in writing by Apex Agency Ltd.
- If you select the monthly billing option, payments will be taken automatically each month until the 12-month term is completed.
- Failure to make payments does not release you from your obligation to pay the full 12-month term.
